Tangeman ignoring, Video--Causation Evidence/Testimony, California Case law and allowing the County of San Luis Obispo to withhold and use evidence from discovery for a small ponding problem that could have been abated by Caltrans for only $43,295.00 as Caltrans and Oceano Community Service District documents showed Judge Martin J. Tangeman! 

 

Our State Highway 1 has flooded and been closed 13 time this year in 2010--See Caltrans Response to the Regional Water Quality Control Board above after Judge Martin J. Tangeman’s Inverse Condemnation decision!

Tangeman has Stated in his August 5, 2008  Superior Court decision regarding Inverse Condemnation: Judge Tangeman misheard Caltrans Testimony on Page 936 As stated by Caltrans—“Now, the we saw earlier a photograph of a Caltrans loader, as you described it , actually in the channel. Do you have I mean, can you tell us why that was done? To your understanding, why that would have been done? Answer. I would imagine that the loader was working in the area. The employee who was running the loader was probably a conscientious employee and wanted to try to help. Question. Do you have a problem with your employees doing Good Neighbor sort of deeds like that? Answer. NO, we do we try to do that when we can.”

San Luis Obispo Superior Court Judge Martin J. Tangeman has ruled this is just being a good neighbor, which has allowed Caltrans District 5 to continue their actions as seen in this first YouTube Video November 26, 2008.

 

Senator Kehoe, I ask that each California Senator is made aware of San Luis Obispo-Superior Court, Judge Martin J. Tangemans--August 5, 2008 Judgment Decision while this goes through the Appellate Court process and is made National News.  

 

Please review Judge Tangemans Statements next to these You Tube Videos under Caltrans.  My Web-Site www.oceanonursery.com has all of the Caltrans documents on it showing why they are now using State Highway 1 for storm water retention and endangering our publics health and safety in order to not flood the Baughman property!

I hope that both of you have had a chance to watch these videos on YouTube of the State of California---Caltrans shoveling and grading contaminated storm water and debris into the Oceano Community’s storm water drainage channel.  San Luis Obispo Superior Court Judge Martin J. Tangeman has ruled this is just being a good neighbor, 

 

Could each of you explain your position on Caltrans actions to our local news media?  It is my intention to bring this to our National News Media in the next couple of weeks, with the New Times Article that has come out this week.

Is This Inverse Condemnation?  Can County's withhold evidence from discovery showing the problems in 2002 before State Highway 1 began flooding?  Can Caltrans now legally Grade and shovel contaminated Storm Water and Debris into our State Drainage Channels?  Can Community Service Districts legally discharge their Well water at 2500 gallons per-minute into California storm water drainage channels without doing any maintenance in regards to the sedimation this push's into our drainage systems?

Statute of Limitations with the Oceano Community Service District; drainage changes in December 2002 (RA Exhibit 1768)and prior as seen in photo exhibits below, with the Oceano Community Service Districts use of this drainage system for discharging 2500 gallons of Well water per minute into this undersized culvert blowing in and cementing debris and silt into this culvert year-around!
 
Flooding Photo in 2002 complained about to Caltrans and the Oceano Community Service District. fixed December 20, 2002---Caltrans and OCSD corrected this drainage problem as seen in APPELLANT’S REPLY BRIEF Exhibit # 1768 as stated by OCSD "I had to meet with Bill Bookout and a couple of guys from cal trans about the 6 inch line from well 8 that ends at the culvert by the railroad tracks.  I had Dan saw off the 6 inch pipe and end it in front of the culvert so that there will be no danger of the pipe plugging debris at the entrance to the culvert."  The Next OCSD log of this drainage system is February 9, 2004 before the first flooding of Oceano Nursery.  OCSD States: "Then Joe had him cleaning out the drainage ditch by the railroad track down at 13th and Front Street"

Your Honors, This is what Caltrans told the Regional Water Quality Control Board after the Judge Tangeman August 5, 2008 decision regarding the Videos presented to Judge Tangeman.

This Statement will have an impact on all of our State Highways.  "Due to past litigation, the Department is no longer responsible or allowed to maintain the channel located off of the Caltrans right of way"

Caltrans District 5 office would like to take this opportunity to express

its unwavering dedication to maintaining the highest levels of compliance

with environmental and water quality protective laws and policies of the

U.S., the State of California, and to the National Pollutant Discharge

Elimination System (NPDES) permit issued to the Department in 1999 (Order

NO. 99-06-DWQ) (CAS000003).

 

The Maintenance Engineer and Area Superintendent for this area were

interviewed regarding the complaint against the Caltrans Maintenance

activity on Highway 1 in Oceano.  Even though this site has a history of

poor drainage that is beyond the control of Caltrans, it was determined

that Department roadway maintenance operations at this location are in

compliance with requirements set forth in Department Stormwater Quality

Guidance Manuals.  The trucks seen with their plow blades lowered are

moving the flooded water and fallen branches off of the road way.

Department personnel maintain the entrance to the drainage channel by

shoveling sediment out of the channel and onto the banks.   When the rain

event is over, Department staff return to remove the shoveled material.

The Maintenance Area Superintendent has agreed to immediately bag the

shoveled material and remove it from the area when maintaining the drainage

flow.

 

Due to past litigation, the Department is no longer responsible or allowed

to maintain the channel located off of the Caltrans right of way.   If you

would like further information about the drainage situation and the

maintenance effort at this location, which has a history beyond what can

be detailed in an e-mail, please let me know so that I can arrange a

meeting with Department staff familiar with the drainage challenges and

restrictions at this site.

As we spoke about earlier today John, here is the blog that Oceano

businessman Bill Bookout has shared with Water Board staff and other

This blog includes photos and videos of Caltrans maintenance workers

plowing and shoveling flood-related debris from Highway 1 into a roadside

ditch.  Mr. Bookout says the Caltrans maintenance supervisor is David Fry

(sp?).  Mr. Bookout asserts that this activity is causing a nearby culvert

beneath the railroad tracks to become clogged with debris, which

exacerbates flooding of his property.

 

Caltrans' NPDES stormwater permit prohibits the discharge of wastes or

wastewater from road sweeping vehicles or from other maintenance or

construction activities to any surface waters or to any storm drain leading

to surface water bodies.  This maintenance activity appears to violate this

prohibition.  Please direct your maintenance staff to immediately

discontinue this activity.  Any flood-related debris should be scooped up

and properly disposed of in an appropriate location.  If we receive any

further complaints regarding this activity, we may find Caltrans in

violation of its NPDES requirements and pursue formal enforcement action.
